Arbitrability of employment disputes in profesional sports in Russia

In 2016 a very remarkable event has taken place in Russian arbitration regulations: employment disputes in professional sports have been recognised to be arbitrable. It has been so provided by the amendments to the Russian Federal Act on Physical Culture and Sport. The author describes situation that existed in Russia before such recognition, set out new rules on such arbitrability and evaluate the meaning of that step. There exist a potential problem of non-compliance of new rules on that arbitrability in the Russian Federal Act on Physical Culture and Sport with the Russian Civil Procedure Code and the Russian Labour Code which still follow old attitudes and regard any employment disputes to be non- arbitrable. It is not excluded that such arbitral novelty in the Russian Federal Act on Physical Culture and Sport may be obstructed until the Russian Supreme Court itself sort that situation out.
